Philip G. Kirk


Philip has more than 15 years of legal practice in Civil Litigation with extensive trial work in the areas of personal injury and land condemnation. He has represented clients in cases against numerous private and public condemnors across North Carolina, receiving verdicts up to 2.6 million dollars. A Wake County native, Philip received his undergraduate degree at Campbell University in 1979 and his law degree from North Carolina Central University in 1984. That same year, he joined the partnership that is today known as Kirk, Kirk, Howell, Cutler & Thomas, L.L.P. Philip Kirk was admitted to practice in the U.S. District Court in 1985 and the U.S. Supreme Court in 1996. He has been appointed by the Chief Justice of the North Carolina Supreme Court to serve on the Justice's Commission on Professionalism. Philip is a husband and father of two as well as an active member of the Wendell community where he serves as the Membership Chair for the Lions Club in addition to an Elder and Planning Committee Chair for his church.

Joseph T. Howell


Joe has been trying cases in the state and federal courts of North Carolina since 1984. He has served as lead counsel in trials in federal court and in 10 different counties across North Carolina. Joe has been before juries in cases involving personal injury, medical malpractice, land condemnation, contract disputes, and real estate. His clients are generally plaintiffs seeking damages in civil litigation and landowners who have had real property taken by government and private condemnors. “Representing the underdog is the most satisfying part of my practice,” says Joe. “The courthouse truly is and should be a place where everybody is given an equal opportunity to go toe to toe with their opponent.” Joe is also a Certified Superior Court Mediator and has mediated hundreds of cases across several North Carolina counties. His trial experiences combined with determination to bring parties to resolution have served his mediation clients well. “Parties expect a good mediator to get to the heart of a matter quickly and to be persistent about getting a case settled. I never forget that mediation probably represents the very best chance a case has to settle. Just going through the motions is unacceptable to me.” A 1980 graduate of North Carolina State University with degrees in Economics and Business Administration, Joe received his legal education at North Carolina Central University School of Law. Joe lives in Wendell with his wife Laurie and their two children. He has raised bad golf to an art form and enjoys time with his family, swimming, biking, and church activities.

Jeffrey M. Cutler

A Raleigh native, Jeff earned his undergraduate degree in Political Science from North Carolina State University in 1986. He earned his law degree from Campbell University School of Law in 1989 where his article "Battered Spouse Syndrome" was published in the Campbell Law Review . Jeff Cutler joined Kirk, Kirk, Howell, Cutler & Thomas, L.L.P. in 1989 and became a partner in 1992. He is engaged in general criminal trial practice, handling major felonies such as capital and non-capital murder cases, drug offenses, assaults, robberies and rape cases. His criminal law practice also includes motor vehicle offenses such as DWI, traffic violations and license revocation and restoration. Jeff is Chief Judge of Precinct 102 for the Wake County Board of Elections, past-president of the Wendell Rotary Club, past board member of the Wendell Chamber of Commerce. He is married with two children and enjoys golfing and coaching youth sports.

C. Terrell Thomas, Jr.


Terrell graduated Summa Cum Laude from Appalachian State University in 1991 and earned his law degree from Wake Forest University in 1994. While in law school, he was a member of the Wake Forest Law Review and the Moot Court. Terrell joined Kirk, Kirk, Howell, Cutler & Thomas, L.L.P. in 1994 and became a partner in 1997. His general practice includes civil litigation, general business representation, family law, workers' compensation, as well as wills and estate planning. He is married and a father of two.
